The sole proprietorship Marion Loew, Gotteslager 1, 37081 Göttingen (hereinafter "we" or "Reitsport Loew"), operates an online shop at the internet address www.reitsport-loew.de, through which equestrian articles and accessories in particular are offered for sale. These General Terms and Conditions (T&Cs) apply to all related legal relationships between Reitsport Loew and the customer ("customer" or "purchaser"), who may be either a consumer within the meaning of § 13 of the German Civil Code (BGB) ("consumer") or an entrepreneur within the meaning of § 14 BGB ("entrepreneur") and must in any case be of legal age.

The customer acknowledges the validity of these T&Cs during the ordering process by clicking on the "I accept your General Terms and Conditions" box and submitting the completed order form.
Any general terms and conditions of the customer shall not apply unless Reitsport Loew has expressly agreed to their validity in advance.

2. Important Information

2.1 Display

The goods offered at www.reitsport-loew.com are displayed on the website clearly and as realistically as possible. However, Reitsport Loew is unable to guarantee that the images and colors the customer sees on their screen will perfectly match reality, due to different screen, graphics, and/or printer settings.


2.2 Availability/Prices of Goods

We point out that the products presented at www.reitsport-loew.de may no longer be available or obtainable at the time of the customer's visit to the website, and the corresponding prices may have changed.


2.3 Disposable Seals

All ordered goods are equipped with return tags attached by disposable seals and are delivered in this condition. When trying on the ordered goods, please be sure not to remove or damage the return tag. We expressly point out that we are not obliged to accept returns of goods where the return tag has been removed or damaged.

3. Conclusion of Contract

3.1 Purchase Agreement

The offer of goods on www.reitsport-loew.de does not constitute a binding contractual offer within the meaning of § 145 BGB, but is to be understood as an invitation to submit an offer (invitatio ad offerendum). By submitting an order by clicking the "buy now" or "submit order" button, you make a binding contractual offer. After submitting the order, you will receive a confirmation email from www.reitsport-loew.de. The confirmation email does not constitute acceptance of the contract. Acceptance of the contract occurs upon shipment of the goods. In the order form, the purchaser accepts the "General Terms and Conditions for the Reitsport Loew Shop". Any input errors made when placing the order can be identified by the customer during final confirmation before the checkout and corrected at any time before the order is sent by using the delete and change functions or by using the "back" button of the internet browser. 3.2 Order Confirmation

The automatic order receipt confirmation sent to the customer after the order is received by Reitsport Loew does not yet constitute acceptance of the contractual offer.


3.3 Contract Text

The contract text is not stored by us and cannot be retrieved after the ordering process is completed. You can print out the order data immediately after submitting it. For this, you can use either the subsequent "Your Order" page or the "Confirmation of Receipt" email. The customer can reach and view these terms and conditions at any time via the "T&Cs" subcategory on the home page. The customer thus has the opportunity to print these T&Cs using the internet browser's "print" function or to save the corresponding webpage locally.


3.4 Contract with Reitsport Loew

Contracts are concluded exclusively with the company Reitsport Loew. "The contract language is German."


3.5 Withdrawal

If the supplier does not supply us with the goods you ordered, we are entitled to withdraw, unless we are at fault in this regard. In this case, we will inform you immediately that the ordered product is not available. If the purchase price has already been paid, it will be refunded to you immediately. The reservation of self-supply applies to consumers in the sense of § 13 BGB only in the event that a congruent hedging transaction was concluded with the supplier, the supplier has let us down in this respect, and Reitsport Loew is not responsible for any incorrect or non-delivery.

5. Delivery and Shipping Costs

5.1 Delivery

Unless otherwise agreed, delivery takes place from the warehouse to the delivery address specified by the purchaser.


5.2 Prices

The prices indicated on Reitsport Loew at the time of the order are authoritative. These are gross prices, i.e., including the respective statutory value-added tax and excluding any applicable shipping costs in accordance with section 5.6.


5.3 International Delivery

We currently deliver to all countries listed under menu item 5.6.

5.3.1 Delivery on DDP (Delivery Duty Paid) basis

Deliveries to the following countries are handled via the DDP (Delivery Duty Paid) service. This means that all applicable transport costs, customs duties, and import VAT are included in the purchase price.

Reitsport Loew bears all costs for door-to-door transport, insurance of the goods, and any costs for accompanying documents. Please note that any foreign bank charges are to be borne by you.

5.4 Delivery to Switzerland and Liechtenstein

The delivery time to Switzerland is generally 2 – 4 working days. Please note that we bear the costs for door-to-door transport, insurance of the goods, costs for accompanying documents, and customs clearance. We also cover the applicable import VAT as well as any customs fees. Please note that any foreign bank charges are to be borne by you. For all deliveries to Switzerland, the stated prices of the items are net prices.


5.5 National Shipments

DHL:

All shipments via DHL cannot generally be delivered to PO box addresses or parcel stations. The terms and conditions of DHL apply in addition and can be read at www.dhl.de

5.6 Shipping Costs

Shipping is carried out by DHL. The following shipping rates apply:

• Germany: €7.50. Free shipping is available for order values of €75.00 and above.
• European shipping zone (see countries below): €16.50. Free shipping is available for order values of €150.00 and above.
• Switzerland: €25.00. Free shipping is available for order values of €150.00 and above.
• Other offered delivery countries outside the aforementioned zones, excluding USA: €65.00. Free shipping is available for order values of €500.00 and above. This also includes Australia and the offered delivery countries in the Middle East.
• USA: 200.00 USD. No free shipping threshold is provided for this shipping rate.

European shipping zone: all EU member states except Germany, as well as Belarus, Kosovo, Liechtenstein, Monaco, Norway, Russia, Serbia, Ukraine, and the United Kingdom. Austria and Liechtenstein belong to this zone; the separate rate above applies to Switzerland.

These rates apply to regular items and procurement items respectively. If a joint order is placed from both groups of items, their shipping costs may be combined. The shipping methods available for your delivery address and order as well as the total shipping costs will be displayed at checkout before completing the order. If the respective free shipping threshold is reached, please select the free shipping option there.

If the customer requests a special method of shipping (e.g., express delivery), they shall bear the additional costs incurred in accordance with the current DHL price list. The risk of transport passes to the customer upon handover of the goods to the carrier, unless the purchaser is a consumer and the order constitutes a consumer goods purchase for them.

6. Payment

The purchaser can pay the purchase price and shipping costs for the ordered items exclusively via PayPal, credit card, Sofortüberweisung, cash on delivery, or prepayment. We reserve the right not to offer certain payment methods for any given order and to refer to another payment method. Should the ordered goods be unavailable, the amount paid in advance will be refunded immediately or credited back to the corresponding credit card.
Please note that some banks may charge separate transfer fees for transactions from abroad. This is completely independent of Reitsport Loew and must be clarified with the respective bank.


6.1 Prepayment

We offer prepayment in the following countries:

For prepayment, payment must be made immediately after the order. Contract acceptance and shipping occur only after receipt of payment. If the payment of the purchase price and shipping costs is not received by Reitsport Loew within 4 working days of the order, Reitsport Loew is entitled to cancel the order.

Financial information for credit card transactions (card number, expiration date, etc.) is automatically forwarded via an encrypted protocol without Reitsport Loew or third parties having access to it in any form. With the exception of refunds for potential returns, this information is never used again. Please note that this is a direct debit.

6.3 Online Security

Reitsport Loew uses SSL (Secure Socket Layer) security software. This is an asymmetric encryption method on the internet that protects your credit card data against eavesdropping and manipulation during transmission. It is therefore impossible for unauthorized parties to read this data during internet transmission.

6.4 Cash on Delivery

We offer cash on delivery in the following countries:

Reitsport Loew generally accepts payment by cash on delivery to a limited extent. However, this only applies to orders that do not exceed the following total order value limits:

France €750, Italy €999.99, and all other mentioned countries €3,850 (excluding shipping costs)

Please note that Reitsport Loew accepts cash on delivery for a maximum of three consecutive orders from a customer that were placed within 5 working days, have not yet been delivered, and do not exceed the aforementioned total value. Reitsport Loew will reject orders via cash on delivery that exceed these limits and inform the customer accordingly. After such a rejection, customers are free to choose a different payment method for their orders. Please note that any refunds can only be made to a bank account.

For cash on delivery orders, a fee of €6.50 applies. You will be informed of the current fees during the ordering process. The invoice amount must be paid in cash to the delivering courier upon receipt of the goods.

Exceptions: Unfortunately, we cannot offer this payment method if your billing address differs from your delivery address (e.g., for gift shipments). Likewise, this payment option is only available in European countries.

7. Retention of Title

The delivered goods remain the property of Reitsport Loew until full payment has been made.

8. Warranty/Liability

8.1 Product Descriptions

Information, drawings, illustrations, technical data, weight, dimension, and performance descriptions contained in brochures, catalogs, circulars, advertisements, or price lists are for purely informational purposes. We assume no liability for the accuracy of this information.


8.2 Liability

Insofar as there is a defect subject to warranty, you are entitled, within the framework of statutory provisions, to demand supplementary performance, to withdraw from the contract after failed supplementary performance, to reduce the purchase price, or, in the event of fault on the part of Reitsport Loew, to claim damages.
For damages other than those arising from injury to life, body, or health, we shall only be liable insofar as these are based on intentional or grossly negligent action or on the culpable breach of a material contractual obligation (a so-called "cardinal duty," i.e., an obligation whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner regularly relies and may rely) by us or our vicarious agents (e.g., the delivery service). Any further liability for damages is excluded. The provisions of the Product Liability Act remain unaffected; furthermore, liability for the fraudulent concealment of a defect as well as for an expressly guaranteed quality remains unlimited.
Data communication via the Internet cannot be guaranteed to be error-free and/or available at all times according to the current state of technology. We are therefore not liable for the constant and uninterrupted availability of our online shop nor for technical and electronic errors during an ordering process over which we have no control.
Insofar as links to other websites or sources are provided, we are not responsible or liable for the availability of such external sites or sources. We do not adopt the content accessible on such websites or sources as our own and exclude any liability or warranty with regard to these, provided there is no positive knowledge of the illegality of the content in individual cases.


8.3 Limitation period

The limitation period for statutory claims for defects is 2 years and begins with the date of delivery, i.e., receipt of the item by the buyer. We ask you to report any visible material, manufacturing, or transport defects immediately; however, this is not a prerequisite for the effective assertion of warranty claims.

9.1 Applicable law

German law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).


9.2 Place of jurisdiction

Insofar as the customer is a merchant, a legal entity under public law, or a special fund under public law, Göttingen is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship.
