1. Scope
The sole proprietorship Marion Loew, Gotteslager 1, 37081 Göttingen, (hereinafter "we" or "Reitsport Loew"), operates an online shop at www.reitsport-loew.de, offering equestrian equipment and accessories for sale. These General Terms and Conditions (GTC) apply to all legal relationships between Reitsport Loew and the customer ("customer" or "purchaser"), who may be either a consumer within the meaning of Section 13 of the German Civil Code (BGB) ("consumer") or an entrepreneur within the meaning of Section 14 of the German Civil Code (BGB) ("entrepreneur") and must in any case be of legal age.
The customer acknowledges the validity of these terms and conditions during the ordering process by clicking the box "I accept your terms and conditions" and submitting the completed order form.
Any terms and conditions of the customer shall not apply unless Reitsport Loew has expressly agreed to their validity beforehand.
2. Important Notes
2.1 Presentation
The goods offered at www.reitsport-loew.com are clearly and largely accurately depicted on the website. However, Reitsport Loew cannot guarantee complete conformity between the images and colors seen on the customer's screen and reality, due to variations in screen, graphics, and/or printer settings.
2.2 Stock/Prices of Goods
Please note that the products presented at www.reitsport-loew.de may no longer be available or in stock at the time of the customer's visit to the website, and the corresponding prices may have changed.
2.3 One-time seals
All ordered goods are shipped with a tamper-evident return label attached. When trying on your order, please be careful not to remove or damage the return label. We expressly state that we are not obligated to accept returns of goods with a removed or damaged return label.
3. Conclusion of the contract
3.1 Purchase agreement
The presentation of goods on www.reitsport-loew.de does not constitute a binding offer within the meaning of § 145 of the German Civil Code (BGB), but rather an invitation to submit an offer (invitatio ad offerendum). By submitting an order by clicking the "Place order" or "Submit order" button, you are making a binding offer. After submitting your order, you will receive a confirmation email from www.reitsport-loew.de. This confirmation email does not constitute acceptance of the contract. The contract is accepted upon shipment of the goods. In the order form, the customer accepts the "General Terms and Conditions for the Reitsport Loew Shop." Any input errors made when placing the order can be identified by the customer during the final confirmation before checkout and corrected at any time before submitting the order using the delete and edit functions, as well as by clicking the "Back" button of the internet browser. The prices valid at the time of ordering apply.
3.2 Order Confirmation
The automatic order confirmation sent to the customer after receipt of the order by Reitsport Loew does not yet constitute acceptance of the contract offer.
3.3 Contract text
The contract text is not stored by us and cannot be retrieved after the order process is complete. You can print the order details immediately after submitting your order. You can do this either from the subsequent "Your Order" page or from the "Order Confirmation" email. The customer can access and view these terms and conditions at any time via the "Terms and Conditions" subcategory on the homepage. The customer can then print these terms and conditions using their internet browser's print function or save the corresponding webpage locally.
3.4 Contract with Reitsport Loew
Contracts are concluded exclusively with the company Reitsport Loew. "The contract language is German."
3.5 Resignation
If the supplier fails to deliver the goods you ordered, we are entitled to withdraw from the contract, unless we are at fault. In this case, we will inform you immediately that the ordered product is unavailable. If the purchase price has already been paid, it will be refunded to you immediately. The reservation of self-supply applies to consumers as defined in § 13 of the German Civil Code (BGB) only if a congruent covering transaction has been concluded with the supplier, the supplier has failed to deliver, and Reitsport Loew is not responsible for any incorrect or non-delivery.

5. Delivery and shipping costs
5.1 Delivery
Unless otherwise agreed, delivery will be made from the warehouse to the delivery address specified by the customer.
5.2 Prices
The prices applicable are those listed on Reitsport Loew at the time of ordering. These are gross prices, i.e., including the applicable statutory value-added tax and excluding any shipping costs that may apply, as per section 5.6.
5.3 International Delivery
We currently deliver to all countries listed under menu item 5.6.
5.3.1 Delivery on a DDP (Delivery Duty Paid) basis
Deliveries to the following countries are handled via the DDP (Delivery Duty Paid) service. This means that all applicable transport costs, customs duties, and import VAT are included in the purchase price.

5.3.2 Deliveries on a DDU (Delivery Duty Unpaid) basis
If you wish to have your order delivered to one of the following countries, please note that the product price shown online does not include customs duties and taxes. Any applicable import VAT and customs duties will be invoiced separately to the recipient by the courier service. We cannot estimate these costs. Please contact the relevant customs authority for further information. Reitsport Loew covers all costs for door-to-door transport, insurance of the goods, and any accompanying documents. Please note that any foreign bank charges are your responsibility.

5.4 Deliveries to Switzerland and Liechtenstein
Delivery to Switzerland typically takes 2-4 business days. Please note that we cover the costs of door-to-door transport, insurance, accompanying documents, and customs clearance. We also cover any applicable import VAT and customs duties. Please be aware that any foreign bank charges are your responsibility. All prices quoted for deliveries to Switzerland are net prices.

Generally, all DHL shipments cannot be delivered to P.O. boxes or parcel lockers. DHL's terms and conditions also apply and can be found at www.dhl.de.

IMPORTANT INFORMATION: If, after a return, the value of your order falls below the amount required for free shipping, we will charge you shipping costs retroactively. 5.7 Special shipping method
If the customer requests a special shipping method (e.g., express delivery), they will bear the additional costs according to DHL's current price list. The risk of loss or damage during transport passes to the customer upon handover of the goods to the carrier, unless the customer is a consumer and the order constitutes a consumer goods purchase.
6. Payment
The purchase price and shipping costs for the ordered items can only be paid by the customer via PayPal, credit card, instant bank transfer, cash on delivery, or advance bank transfer. We reserve the right to not offer certain payment methods for any given order and to refer the customer to an alternative payment method. Should the ordered goods be unavailable, the advance payment will be refunded immediately or credited back to the corresponding credit card.
Please note that some banks may charge separate transfer fees for international transactions. This is completely independent of Reitsport Loew and must be clarified with your bank.
6.1 Advance payment
We offer advance payment in the following countries:

For advance payment, this must be made immediately after placing the order. The contract is only accepted and the goods shipped after payment has been received. If the transfer of the purchase price and shipping costs is not received by Reitsport Loew within 4 business days of placing the order, Reitsport Loew is entitled to cancel the order.

Financial information for credit card transactions (card number, expiration date, etc.) is automatically transmitted using an encrypted protocol, without Reitsport Loew or any third party having access to it in any way. This information will never be used again, except for processing refunds in the event of returns. Please note that this is a direct debit.
6.3 Online Security
Loew Equestrian Sports uses SSL (Secure Socket Layer) security software. This is an asymmetric encryption method used on the internet that protects your credit card information from eavesdropping and manipulation during transmission. This means that unauthorized persons cannot read this data while it is being transmitted over the internet.
6.4 Cash on delivery
We offer cash on delivery in the following countries:

Loew Equestrian Sports generally accepts cash on delivery payments to a limited extent. However, this only applies to orders that do not exceed the following maximum order values:
France €750, Italy €999.99 and all other mentioned countries €3,850 (excluding shipping costs)
Please note that Reitsport Loew accepts cash-on-delivery orders for a maximum of three consecutive orders from the same customer, placed within 5 business days but not yet shipped, and whose total value does not exceed the aforementioned limit. Reitsport Loew will reject cash-on-delivery orders exceeding these limits and will inform the customer accordingly. Following such a rejection, customers are free to choose a different payment method for their orders. Please note that any refunds can only be issued to a bank account.
A COD fee of €6.50 applies to cash-on-delivery orders. You will be informed of the current fee amount during the ordering process. The invoice amount is payable in cash to the delivery driver upon receipt of the goods.
Exceptions: Unfortunately, we cannot offer this payment method if your billing address differs from your delivery address (e.g., for gift shipments). This payment option is also only available in European countries.
7. Retention of title
The delivered goods remain the property of Reitsport Loew until full payment has been received.
8. Warranty/Liability
8.1 Product descriptions
Information, drawings, illustrations, technical data, weight, dimension and performance specifications contained in brochures, catalogs, circulars, advertisements or price lists are for informational purposes only. We assume no liability for the accuracy of this information.
8.2 Liability
Insofar as a defect covered by warranty exists, you are entitled, within the framework of the statutory provisions, to demand subsequent performance, to withdraw from the contract after failed subsequent performance, to reduce the purchase price, or, in the case of fault on the part of Reitsport Loew, to claim damages.
For damages other than those resulting from injury to life, body, or health, we are only liable to the extent that such damages are caused by intentional or grossly negligent conduct or by a culpable breach of a fundamental contractual obligation (a so-called "cardinal obligation," i.e., an obligation whose fulfillment is essential for the proper performance of the contract and on whose compliance the contractual partner regularly relies and may rely) by us or our agents (e.g., the delivery service). Any further liability for damages is excluded. The provisions of the Product Liability Act remain unaffected; liability for the fraudulent concealment of a defect and for an expressly guaranteed quality also remains unlimited.
Data communication via the internet cannot be guaranteed to be error-free and/or available at all times, given the current state of technology. Therefore, we are not liable for the constant and uninterrupted availability of our online shop, nor for technical or electronic errors during the ordering process that are beyond our control.
If links to other websites or sources are provided, we are not responsible or liable for the availability of such external sites or sources. We do not endorse any content accessible on such websites or sources and exclude all liability or warranty with respect to them, unless we have actual knowledge of the illegality of the content in a specific case.
8.3 Limitation period
The limitation period for statutory warranty claims is two years and begins on the date of delivery, i.e., receipt of the goods by the buyer. We ask that you report any visible material, manufacturing, or transport defects immediately; however, this is not a prerequisite for the effective assertion of warranty claims.

9. Final Provisions
9.1 Applicable Law
German law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
9.2 Place of jurisdiction
If the customer is a merchant, a legal entity under public law or a special fund under public law, Göttingen shall be the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship.
9.3 Ineffective business terms

Should any provision of these terms and conditions be or become invalid, the validity of all other provisions or agreements shall remain unaffected. The relevant statutory provisions shall apply in place of the invalid provisions.
