The sole proprietorship Marion Loew, Gotteslager 1, 37081 Göttingen, (hereinafter "we" or "Reitsport Loew"), operates an online shop at the internet address www.reitsport-loew.de, through which equestrian articles and accessories, in particular, are offered for sale. These General Terms and Conditions (GTC) apply to all related legal relationships between Reitsport Loew and the customer ("customer" or "orderer"), who can be either a consumer within the meaning of § 13 BGB ("consumer") or an entrepreneur within the meaning of § 14 BGB ("entrepreneur") and must in any case be of legal age.

The customer acknowledges the validity of these GTC during the ordering process by clicking the "I accept your General Terms and Conditions" box and submitting the completed order form.
Any terms and conditions of the customer do not apply, unless Reitsport Loew has expressly agreed to their validity in advance.

2. Important Notes

2.1 Display

The goods offered on www.reitsport-loew.com are clearly and largely realistically displayed on the website. However, Reitsport Loew is unable to guarantee complete conformity with reality for the images and colors that the customer sees on their screen, also due to different screen, graphics, and/or printer settings.


2.2 Availability/Prices of Goods

We point out that the products presented on www.reitsport-loew.de may no longer be available or obtainable at the time of the customer's visit to the website, and the corresponding prices may have changed.


2.3 One-time Seal

All ordered goods are delivered with reimbursement tags attached by one-time seals. If you try on the ordered goods, please make sure not to remove or damage the reimbursement tag. We expressly point out that we are not obliged to take back goods from which the reimbursement tag has been removed or damaged.

3. Conclusion of Contract

3.1 Purchase Agreement

The offer of goods on www.reitsport-loew.de is not a binding contractual offer within the meaning of § 145 BGB, but is to be understood as an invitation to submit an offer (invitatio ad offerendum). By submitting an order by clicking the "Order with obligation to pay" or "Submit order" button, you submit a binding contractual offer. After submitting the order, you will receive a confirmation email from www.reitsport-loew.de. The confirmation email does not constitute acceptance of the contract. The contract is accepted by shipping the goods. In the order form, the orderer accepts the "General Terms and Conditions for the Reitsport Loew-Shop". Any input errors when placing the order can be recognized by the customer in the final confirmation before checkout and can be corrected at any time before submitting the order using the delete and change function and by activating the "back function" of the internet browser. The prices at the time of the order apply.


3.2 Order Confirmation

The automatic order receipt confirmation sent to the customer after Reitsport Loew receives the order does not yet constitute acceptance of the contractual offer.


3.3 Contract Text

The contract text is not stored by us and can no longer be retrieved after the order process has been completed. You can print the order data immediately after sending. For this purpose, you can either use the subsequent "Your Order" page or the "Receipt Confirmation" email. The customer can access and view these contract terms at any time via the "GTC" subcategory from the homepage. The customer thus has the opportunity to print these GTC using the "Print function" of the internet browser or to save the corresponding website locally.


3.4 Contract with Reitsport Loew

Contracts are concluded exclusively with Reitsport Loew. "The contract language is German."


3.5 Withdrawal

If the supplier does not deliver the goods you ordered to us, we are entitled to withdraw, unless we are at fault in this respect. In this case, we will inform you immediately that the ordered product is not available. If the purchase price has already been paid, it will be refunded to you immediately. The reservation of self-delivery applies to consumers within the meaning of § 13 BGB only in the event that a congruent covering transaction has been concluded with the supplier, the supplier has let us down in this respect, and Reitsport Loew is not responsible for any incorrect or non-delivery.

5. Delivery and Shipping Costs

5.1 Delivery

Unless otherwise agreed, delivery will be ex-warehouse to the delivery address specified by the orderer.


5.2 Prices

The prices stated on Reitsport Loew at the time of the order are decisive. These are gross prices, i.e., including the respective statutory sales tax and excluding any shipping costs that may arise according to Section 5.6.


5.3 International Delivery

We currently deliver to all countries listed under menu item 5.6.

5.3.1 Delivery on DDP (Delivery Duty Paid) Basis

Deliveries to the following countries are handled via the DDP (Delivery Duty Paid) service. This means that all applicable transport costs, customs duties, and import sales taxes are included in the purchase price.

The applicable import sales tax and any customs fees will be charged separately to the recipient by the courier service. These costs cannot be estimated by us. Please contact the responsible customs authority. Reitsport Loew bears all costs for door-to-door transport, insurance of the goods, and any costs for accompanying documents. Please note that any foreign bank charges may be borne by you.

The delivery time to Switzerland is usually 2 – 4 working days. Please note that we bear the costs for door-to-door transport, the insurance of the goods, the costs for accompanying documents, and customs clearance. We also cover the applicable import sales tax and any customs duties. Please note that any foreign bank charges may be borne by you. For all deliveries to Switzerland, the prices indicated for the articles are net prices.


5.5 National Shipments

DHL:

All shipments via DHL generally cannot be delivered to post office boxes or packing stations. The terms and conditions of DHL apply additionally and can be viewed at www.dhl.de

5.7 Special Shipping Method

 

If the customer requests a special method of shipping (e.g., express delivery), the customer shall bear the additional costs incurred for this according to the currently valid DHL price list. The risk of transport passes to the customer upon handover of the goods to the carrier, unless the orderer is a consumer and the order constitutes a consumer goods purchase for them.

6. Payment

The orderer can pay the purchase price and shipping costs for the ordered items exclusively with PayPal, credit card, instant transfer (Sofortüberweisung), cash on delivery (Nachnahme), or by advance bank transfer. We reserve the right to not offer certain payment methods for any order and to refer to another payment method. If the ordered goods are unavailable, the amount transferred in advance will be refunded immediately or credited back to the corresponding credit card.
Please note that some banks may charge separate transfer fees for transactions from abroad. However, this is completely independent of Reitsport Loew and can only be clarified with the respective bank.


6.1 Advance Bank Transfer

We offer advance bank transfer in the following countries:

For advance bank transfers, this must be made immediately after placing the order. Contract acceptance and dispatch will only take place after receipt of payment. If the bank transfer of the purchase price and shipping costs is not received by Reitsport Loew within 4 working days of the order, Reitsport Loew is entitled to cancel the order.

The financial information for credit card transactions (card number, expiration date, etc.) is automatically transmitted with an encrypted protocol, without Reitsport Loew or third parties having access to it in any form. This information will also never be reused, with the exception of refunds for any returns. Please note that this is a direct debit.

6.3 Online Security

Reitsport Loew uses SSL (Secure Socket Layer) security software. This is an asymmetric encryption method on the internet that protects your credit card data against eavesdropping and manipulation during transmission. During transmission on the internet, it is thus not possible for unauthorized persons to read this data.

6.4 Cash on Delivery

We offer cash on delivery in the following countries:

Reitsport Loew generally accepts payment by cash on delivery to a limited extent. However, this only applies to orders that do not exceed the following upper limits of the total order value:

France €750, Italy €999.99, and all other mentioned countries €3,850 (excluding shipping costs)

Please note that Reitsport Loew accepts cash on delivery orders for a maximum of three consecutive orders from a customer, placed within 5 working days but not yet delivered, and whose total does not exceed the above-mentioned value. Reitsport Loew will reject cash on delivery orders above these limits and inform the customer accordingly. After such a rejection, customers are free to choose another payment method for their orders. Please note that any refunds can only be made to a bank account.

For cash on delivery orders, a cash on delivery fee of €6.50 applies. You will be informed of the amount of the current fees during the ordering process. The invoice amount is to be paid in cash to the delivering courier upon receipt of the goods.

Exceptions: Unfortunately, we cannot offer you this payment method if your billing address differs from the delivery address (e.g., for gift shipments). Likewise, this payment option is only available in European countries.

7. Retention of Title

The delivered goods remain the property of Reitsport Loew until full payment has been made.

8. Warranty/Liability

8.1 Product descriptions

Information, drawings, illustrations, technical data, weight, dimension and performance descriptions contained in brochures, catalogues, circulars, advertisements or price lists are purely informative. We do not guarantee the accuracy of this information.


8.2 Liability

If there is a defect subject to warranty, you are entitled, within the framework of the statutory provisions, to demand supplementary performance, to withdraw from the contract after failed supplementary performance, to reduce the purchase price or, in the event of culpability on the part of Reitsport Loew, to claim damages.
For damages other than those resulting from injury to life, body and health, we are only liable insofar as these are based on intentional or grossly negligent action or on the culpable breach of an essential contractual obligation (so-called "cardinal obligation", i.e. an obligation whose fulfilment is essential for the proper execution of the contract and on whose observance the contracting party regularly trusts and may trust) by us or our vicarious agents (e.g. the delivery service). Any further liability for damages is excluded. The provisions of the Product Liability Act remain unaffected; liability for fraudulently concealing a defect and for an expressly guaranteed quality also remains unlimited.
Data communication via the internet cannot be guaranteed to be error-free and/or available at all times according to the current state of the art. We are therefore not liable for the constant and uninterrupted availability of our online shop nor for technical and electronic errors during an order process over which we have no influence.
If links to other websites or sources are created, we are not responsible or liable for the availability of such external sites or sources. We do not adopt contents accessible on such websites or sources as our own and exclude any liability or warranty with regard to these, unless there is positive knowledge of the illegality of the contents in individual cases.


8.3 Limitation period

The limitation period for statutory claims for defects is 2 years and begins on the date of delivery, i.e. receipt of the goods by the buyer. We ask you to report any visible material, manufacturing or transport defects immediately, but this is not a prerequisite for the effective assertion of warranty claims.

9. Final provisions

9.1 Applicable Law

German law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).


9.2 Place of jurisdiction

If the customer is a merchant, a legal entity under public law or a special fund under public law, Göttingen is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship.


9.3 Invalid terms and conditions
