1. scope of application
The sole proprietorship Marion Loew, Gotteslager 1, 37081Göttingen, (hereinafter referred to as "we" or "Reitsport Loew"), operates an online store at the Internet address www.reitsport-loew.de, through which in particular equestrian articles and accessories are offered for sale. These General Terms and Conditions (GTC) apply to all legal relationships in this respect between Reitsport Loew and the customer ("customer" or "purchaser"), who can be either a consumer within the meaning of § 13 BGB ("consumer") or an entrepreneur within the meaning of § 14 BGB ("entrepreneur") and must in any case be of legal age.
The customer acknowledges the validity of these General Terms and Conditions during the ordering process by clicking on the "I accept your General Terms and Conditions" field and submitting the completed order form.
Any terms and conditions of the customer shall not apply unless Reitsport Loew has previously expressly agreed to their validity.

2.1 Presentation
The goods offered at www.reitsport-loew.com are presented on the website clearly and largely in accordance with reality. However, Reitsport Loew is not in a position to guarantee that the images and colors that the customer sees on his screen, also due to different screen, graphic and/or printer settings, fully correspond to reality.
2.2 Availability/prices of the goods
We would like to point out that the products presented at www.reitsport-loew.de may no longer be available or available at the time the customer visits the website and that the corresponding prices may have changed.
2.3 Disposable seal
All ordered goods are provided with disposable seal-attached refund labels and are delivered as such. If you try on the ordered goods, please ensure that you do not remove or damage the refund label. We expressly point out that we are not obliged to take back goods from which the refund label has been removed or damaged.
3 Conclusion of contract
3.1 Purchase contract
The offer of goods on www.reitsport-loew.de is not a binding contractual offer within the meaning of § 145 BGB, but is to be understood as an invitation to submit an offer (invitatio ad offerendum). By sending an order by clicking the button "order with obligation to pay" or "send order", you are submitting a binding contractual offer. After sending the order, you will receive a confirmation email from www.reitsport-loew.de. The confirmation email does not constitute acceptance of the contract. The contract is accepted when the goods are dispatched. In the order form, the customer accepts the "General Terms and Conditions for the Reitsport Loew-Shop". The customer can recognize any input errors when placing the order during the final confirmation before the checkout and correct them at any time by using the delete and change function and by pressing the "back function" of the Internet browser before sending the order. The prices at the time of the order shall apply.
3.2 Order confirmation
The automatic order confirmation sent to the customer after receipt of the order by Reitsport Loew does not constitute acceptance of the contract offer.
3.3 Text of the contract
The text of the contract is not stored by us and can no longer be retrieved after completion of the order process. You can print out the order data immediately after submitting the order. To do this, you can either use the subsequent "Your order" page or the "Confirmation of receipt" e-mail. The customer can access and view these contractual terms and conditions at any time via the "Terms and conditions" sub-category from the homepage. The customer has the possibility to print these terms and conditions with the "print function" of the Internet browser or to save the corresponding web page locally.
3.4 Contract with Reitsport Loew
Contracts are concluded exclusively with the company Reitsport Loew "Contract language is German"
3.5 Withdrawal
If the supplier does not supply us with the goods ordered by you, we are entitled to withdraw from the contract, unless we are at fault in this respect. In this case, we will inform you immediately that the ordered product is not available. If the purchase price has already been paid, it will be refunded to you immediately. The reservation of self-supply shall apply to consumers within the meaning of § 13 BGB only in the event that a congruent hedging transaction has been concluded with the supplier, the supplier has let us down in this respect and Reitsport Loew is not responsible for any incorrect or non-delivery.

5 Delivery and shipping costs
5.1 Delivery
Unless otherwise agreed, delivery shall be ex warehouse to the delivery address specified by the customer.
5.2 Prices
The prices stated on Reitsport Loew at the time of the order are decisive. These are gross prices, i.e. including the respective statutory value added tax and excluding any shipping costs incurred in accordance with paragraph 5.6.
5.3 International delivery
We currently deliver to all countries listed under menu item 5.6.
5.3.1 Delivery on a DDP (Delivery Duty Paid) basis
Deliveries to the following countries are processed via the DDP (Delivery Duty Paid) service. This means that all transportation costs, customs duties and import sales taxes are included in the purchase price.

5.3.2 Deliveries on a DDU/Delivery Duty Unpaid) basis
If you require delivery to one of the following countries, please note that the product price stated on the website does not include customs duties and taxes. The applicable import sales tax and any customs duties will be invoiced separately to the recipient by the courier service. These costs cannot be estimated by us. Please contact the relevant customs authority. All costs for door-to-door transportation, insurance of the goods and any costs for accompanying documents shall be borne by Reitsport Loew. Please note that any foreign bank charges are to be borne by you.

5.4 Deliveries to Switzerland and Liechtenstein
The delivery time to Switzerland is usually 2 - 4 working days. Please note that we bear the costs for door-to-door transportation, insurance of the goods, the costs for accompanying documents and customs clearance. We will also pay the import sales tax and any customs duties. Please note that any foreign bank charges are to be borne by you. For all deliveries to Switzerland, the prices quoted for the items are net prices.
5.5 National shipments
DHL:
All shipments via DHL can generally not be delivered to P.O. Box addresses or Packstations. The DHL terms and conditions apply in addition and can be found at www.dhl.de

5.7 Special shipping method
If the customer requests a special shipping method (e.g. express delivery), the customer shall bear the additional costs incurred for this in accordance with the DHL price list valid at the time. The risk of transportation is transferred to the customer when the goods are handed over to the carrier, unless the customer is a consumer and the order represents a purchase of consumer goods.

6. payment
The purchase price and shipping costs for the ordered items can only be paid by PayPal, credit card, instant bank transfer, cash on delivery or advance bank transfer. We reserve the right not to offer certain payment methods for each order and to refer to another payment method. If the ordered goods are not available, the amount transferred in advance will be refunded immediately or credited back to the corresponding credit card.
Please note that some banks may charge separate transfer fees for transactions from abroad. However, this is completely independent of Reitsport Loew and can only be clarified with the respective bank.
6.1 Advance bank transfer
We offer advance bank transfer in the following countries:

In the case of advance bank transfer, this must be made immediately after placing the order. Acceptance of the contract and shipment will only take place after receipt of payment. If the transfer of the purchase price and shipping costs is not received by Reitsport Loew within 4 working days of the order, Reitsport Loew is entitled to cancel the order.

The financial information for credit card transactions (card number, expiration date, etc.) is automatically forwarded using an encrypted protocol without Reitsport Loew or third parties having access to it in any way. This information is never used again, with the exception of refunds in the event of returns. Please note that this is a direct debit.
6.3 Online security
Reitsport Loew uses SSL (Secure Socket Layer) security software. This is an asymmetric encryption method on the Internet that protects your credit card data against interception and manipulation during transmission. It is therefore not possible for unauthorized persons to read this data during transmission on the Internet.
6.4 Cash on delivery
We offer cash on delivery in the following countries:

Reitsport Loew also accepts cash on delivery to a limited extent. However, this only applies to orders that do not exceed the following upper limits of the total order value:
France 750€, Italy 999,99€ and all other mentioned countries 3.850€ (without shipping costs)
Please note that Reitsport Loew accepts cash on delivery orders for a maximum of three consecutive orders placed by a customer within 5 working days, which have not yet been delivered and which in total do not exceed the above-mentioned value. Reitsport Loew will reject cash on delivery orders above these limits and inform the customer accordingly. After such a rejection, customers are free to choose another payment method for their orders. Please note that any refunds can only be made to a bank account.
Cash on delivery orders are subject to a cash on delivery fee of 6.50 EUR. You will be informed of the current charges during the ordering process. The invoice amount is to be paid in cash to the delivering courier upon receipt of the goods.
Exceptions: Unfortunately, we cannot offer you this payment method if your billing address is different from the delivery address (e.g. for gift shipments). This payment option is also only available in European countries.
7 Retention of title
The delivered goods remain the property of Reitsport Loew until full payment has been received.
8 Warranty/Liability
8.1 Product descriptions
Information, drawings, illustrations, technical data, weight, dimension and performance descriptions contained in brochures, catalogs, circulars, advertisements or price lists are for information purposes only. We accept no liability for the accuracy of this information.
8.2 Liability
If there is a defect subject to warranty, you are entitled within the framework of the statutory provisions to demand subsequent performance, to withdraw from the contract after failed subsequent performance, to reduce the purchase price or to claim damages in the event of fault on the part of Reitsport Loew.
We shall only be liable for damages other than those resulting from injury to life, body and health insofar as these are based on intentional or grossly negligent action or on culpable breach of an essential contractual obligation (so-called "cardinal obligation", i.e. an obligation whose fulfillment is essential for the proper execution of the contract and on whose compliance the contractual partner regularly relies and may rely) by us or our vicarious agents (e.g. the delivery service). Any further liability for damages is excluded. The provisions of the Product Liability Act shall remain unaffected by this; liability for fraudulent concealment of a defect and for an expressly guaranteed quality shall also remain unrestricted.
According to the current state of technology, data communication via the Internet cannot be guaranteed to be error-free and/or available at all times. We are therefore neither liable for the constant and uninterrupted availability of our online store nor for technical and electronic errors during an order process over which we have no influence.
If links to other websites or sources are created, we are not responsible or liable for the availability of such external sites or sources. We do not adopt content that is accessible on such websites or sources as our own and exclude any liability or warranty in relation to them, unless we have positive knowledge of the illegality of the content in individual cases.
8.3 Limitation period
The limitation period for statutory claims for defects is 2 years and begins on the date of delivery, i.e. receipt of the item by the buyer. We ask you to notify us immediately of any visible material, manufacturing or transportation defects; however, this is not a prerequisite for the effective assertion of warranty claims.

9 Final provisions
9.1 Applicable law
German law shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
9.2 Place of jurisdiction
If the customer is a merchant, a legal entity under public law or a special fund under public law, Göttingen shall be the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship.
9.3 Invalid terms and conditions
